2. Purpose

This Legal Notice governs access to, browsing of and use of the website easyrent.es (the “Website”), owned by DIGIRENT SOLUTIONS, S.L. (“EasyRent”).

Accessing the Website confers user status and implies full and unreserved acceptance of all the provisions of this Legal Notice, in the version published at the time of access. EasyRent recommends that users read this text carefully each time they access the Website.

3. Conditions of access and use

Access to the Website is free of charge, except for the cost of the internet connection provided by the user’s own service provider.

The user undertakes to make appropriate and lawful use of the Website and its contents, in accordance with applicable law, this Legal Notice, public morals and good practice. In particular, the user shall refrain from:

Using the Website for unlawful purposes, or purposes harmful to the rights and interests of third parties, or which may damage, disable, overload or impair the Website or prevent its normal use.
Introducing or spreading computer viruses or any other physical or logical systems capable of causing damage.
Attempting to access, use or manipulate the data of EasyRent, of third-party suppliers or of other users.
Reproducing, copying, distributing, transforming or modifying the contents of the Website without the express written authorisation of the owner.
Deleting, concealing or manipulating content protected by intellectual or industrial property rights.
Using automated data extraction systems (scraping, crawling, robots) on the contents of the Website, in particular on property listings, without prior written authorisation.

EasyRent reserves the right to deny or withdraw access to the Website, at any time and without prior notice, to users who breach the terms of this Legal Notice.

4. Intellectual and industrial property

All content on the Website — including, without limitation, text, photographs, graphics, images, icons, technology, software, links, floor plans and property descriptions, as well as its graphic design and source code — is the property of EasyRent. No exploitation rights over such content are transferred to the user beyond what is strictly necessary for the proper use of the Website.

Trademarks, trade names and distinctive signs belong to EasyRent or to third parties who have authorised their use. Access to the Website does not confer any right over them.

Photographs of the properties published are owned by EasyRent or used with the authorisation of their owners. Their reproduction or use without express consent is prohibited.

5. Property listing content

Information relating to properties published on the Website (surface area, location, features, price, availability and conditions) is provided for information and guidance purposes only, and does not constitute a binding contractual offer under Article 1,262 of the Spanish Civil Code.

Some of the data published comes from information supplied by property owners. EasyRent makes reasonable efforts to verify such information but cannot guarantee its absolute accuracy or that it will remain current. Property availability is subject to change without notice.

The final conditions of any tenancy shall be those set out in the contract signed between the parties, where applicable.

6. Exclusion of liability

EasyRent does not guarantee the availability or continuity of the operation of the Website. Where reasonably possible, it will give prior notice of interruptions. Within the limits established by law, EasyRent shall not be liable for damages caused to the user as a result of unavailability, access failures or lack of continuity of the Website.

EasyRent is not responsible for any errors or omissions in the contents of the Website, nor for damages arising from the user’s use of such contents.

7. Third-party links

The Website may contain links to third-party websites. EasyRent exercises no control over such sites and is not responsible for their content, privacy policies or practices. The inclusion of a link does not imply approval, sponsorship or recommendation of the linked site.

8. Personal data protection

The processing of users’ personal data is governed by the Privacy Policy and the Cookie Policy.

9. Dispute resolution and governing law

This Legal Notice is governed by Spanish law.

For the resolution of any dispute arising from access to or use of the Website, the parties submit to the Courts of the user’s place of residence where the user is a consumer. In all other cases, the parties submit to the Courts of the city of Valencia, expressly waiving any other jurisdiction to which they may be entitled.

10. Amendments

EasyRent reserves the right to amend the content of this Legal Notice, as well as the presentation and configuration of the Website, at any time and without prior notice.

11. Language

This document is a translation of the Spanish original. In the event of any discrepancy between the two versions, the Spanish version shall prevail.
