Terms and Conditions of Use

1. Identification and acceptance

These Terms and Conditions (the “Terms”) govern the use of the website easyrent.es and of the services offered through it by DIGIRENT SOLUTIONS, S.L. (“EasyRent”), Tax ID B22547483, with registered office at Calle Salvá 8, 1º, 2B, 46002 Valencia, registered at the Commercial Registry of Valencia, Section 8, Sheet V-226372, Entry 1.

Accessing and using the website implies acceptance of these Terms, the Legal Notice, the Privacy Policy and the Cookie Policy.

Important: these Terms govern use of the website and requests for information. They do not constitute the service agreement or the tenancy agreement, which will be entered into, where applicable, by way of a separate document signed by the parties.

2. EasyRent’s services

EasyRent provides property management and marketing services in the city of Valencia and its metropolitan area, including, among others:

  • Full rental management: marketing the property, tenant selection, contract preparation, rent collection, incident handling and ongoing tenancy management.
  • Medium- and long-term lettings, and room lettings.
  • Renovation projects and preparation of properties for letting.
  • Investment opportunity sourcing and asset management.

The specific scope, duration, fees and conditions of each service will be agreed in the individual contract signed with each client.

3. Use of the website

The website allows users to browse available properties, learn about EasyRent’s services and get in touch through the forms provided.

The user undertakes to:

  • Provide truthful, accurate and up-to-date information in the forms.
  • Not impersonate third parties.
  • Not use the website for fraudulent or unlawful purposes.
  • Not extract website content by automated means, in particular property listings and their photographs.

EasyRent may refuse or cancel access for any user who breaches these obligations.

4. Property information

Information published about properties (surface area, layout, features, price, charges, availability and photographs) is provided for information purposes and is not binding. It does not constitute a contractual offer under Article 1,262 of the Spanish Civil Code.

Prices are expressed in euros. Unless expressly stated otherwise, they do not include utilities, service charges, deposit, additional guarantees or any applicable taxes.

Property availability may change without notice. EasyRent does not guarantee that a published property will still be available at the time of your enquiry.

Photographs are indicative and may not reflect the current condition of the property or its furnishings.

5. Enquiries and viewings

Submitting a contact form or viewing request does not create any right over the property, nor does it constitute a reservation, purchase option or commitment to let.

EasyRent will deal with requests subject to availability, with no obligation to arrange a viewing or to accept any application.

6. Tenant selection process

Tenants are selected on the basis of financial standing and suitability for the property.

Documentary evidence of identity, employment status and income may be requested, and credit information systems may be consulted, as detailed in the Privacy Policy.

The final decision on the allocation of a property rests with the property owner. EasyRent acts as intermediary and manager and does not guarantee that any application will be accepted. Non-acceptance of an application does not give rise to any right to compensation.

7. Prices, reservations and payments

7.1 Prices

Property and service prices are expressed in euros.

Published rental amounts do not include, unless expressly stated, utilities, service charges, local taxes, deposit or additional guarantees.

Residential lettings are exempt from VAT under Article 20.One.23 of Spanish Law 37/1992 on Value Added Tax. Management and intermediation services provided by EasyRent are subject to VAT at the standard rate in force, which will be itemised separately on the invoice.

7.2 Reservations

EasyRent allows a reservation payment to be made through the website in order to temporarily withdraw a property from the market while documentary verification is completed and the contract is prepared.

Before completing payment, the user will be clearly informed in advance of:

  • The exact amount of the reservation.
  • The period for which the property will be reserved.
  • What the amount will be applied to: the first month’s rent, the deposit or another item.
  • The conditions and time limits for refunds.

Refund of the reservation. The reservation amount will be refunded in full where:

  • The property owner ultimately does not accept the application.
  • The property ceases to be available for reasons not attributable to the user.
  • The contract is not entered into for reasons not attributable to the user.
  • A duly evidenced event of force majeure occurs.

Refunds will be made using the same payment method, within a maximum of 14 calendar days from the occurrence of any of the above circumstances.

Nature of the reservation. The reservation constitutes a deposit or confirmatory earnest payment. Its payment withdraws the property from the market, with the resulting opportunity cost for the owner and for EasyRent.

Prior consent. Before completing payment, the user must expressly confirm, by means of a specific non-pre-ticked box:

  1. That they request that performance of the service begin immediately, without waiting for the withdrawal period to expire.
  2. That they have been informed that, once the service has been fully performed, they will lose the right of withdrawal under Article 103.a) of Spanish Royal Legislative Decree 1/2007.

Withdrawal by the user. If, having given the above consent and once the property has been withdrawn from the market and the application processed, the user withdraws from the transaction for reasons attributable to them, the reservation amount will be retained by EasyRent as compensation for the management costs and opportunity cost incurred.

Exceptions. The amount will be refunded in full where the withdrawal is due to a duly evidenced event of force majeure, and in the circumstances set out in the following paragraph.

Reciprocity. If the transaction does not proceed for reasons attributable to EasyRent or to the property owner, the user shall be entitled to a full refund of the amount paid, increased by an equivalent amount by way of compensation, together with reimbursement of any evidenced costs incurred as a result of the reservation.

Nothing in this section limits the non-waivable rights afforded to the user as a consumer under Royal Legislative Decree 1/2007.

7.3 Deposit

The statutory deposit is governed by Article 36 of Spanish Law 29/1994 on Urban Tenancies and is equivalent to one month’s rent for residential lettings.

The deposit is not a payment to EasyRent: it is lodged with the competent body of the Generalitat Valenciana in accordance with regional legislation, and is returned to the tenant at the end of the tenancy on the terms provided by law.

7.4 Management fees

Under Article 20.1 of Spanish Law 29/1994 on Urban Tenancies, as amended by Law 12/2023 of 24 May on the right to housing, property management costs and the costs of preparing the contract are borne by the landlord in residential tenancies subject to that law.

Accordingly, EasyRent does not pass on intermediation fees to tenants in residential tenancies, nor any equivalent charge for administration, processing, contract preparation or utility connection.

For lettings for purposes other than residential use, and for seasonal lettings, to which the above restriction does not apply, any amount payable by the tenant will be expressly, itemised and notified in advance of payment, and accepted in writing.

Services provided to property owners are invoiced in accordance with the management contract signed with each client.

7.5 Payment methods

Payments through the website are processed by Stripe Payments Europe, Ltd., an authorised and supervised payment institution.

EasyRent does not store or have access to your full card details. Card data is entered directly within Stripe’s secure environment, which complies with the PCI DSS standard and applies the strong customer authentication required by Directive (EU) 2015/2366 on payment services.

7.6 Invoicing

Invoices will be issued and sent electronically to the email address provided by the user, in respect of amounts constituting consideration for services provided by EasyRent.

8. Right of withdrawal

Where the user is a consumer within the meaning of Royal Legislative Decree 1/2007 and contracts EasyRent’s services at a distance or off-premises, they shall have a period of 14 calendar days to withdraw from the contract without giving any reason and without penalty.

Calculation of the period. The period begins on the day the service contract is concluded.

How to exercise it. By notifying us unequivocally at info@easyrent.es or in writing to Calle Salvá 8, 1º, 2B, 46002 Valencia, before the period expires. You may use the model withdrawal form in Annex B of Royal Legislative Decree 1/2007, although its use is not compulsory.

Effects. EasyRent will refund the amounts received using the same payment method, without undue delay and within a maximum of 14 calendar days from receipt of the withdrawal notice.

Performance begun during the withdrawal period. If the user expressly requests that performance of the service begin during the withdrawal period and subsequently withdraws, they must pay the proportionate part of the service already provided up to the time of notification.

Exceptions. The right of withdrawal does not apply to residential tenancy agreements once concluded, which are governed by Law 29/1994 on Urban Tenancies, nor to the cases excluded by Article 103 of Royal Legislative Decree 1/2007.

Relationship with the reservation. Payment of a reservation through the website constitutes the conclusion of the service contract with EasyRent. As set out in section 7.2, the user confirms, prior to payment, that they request immediate commencement of performance and that they understand they will lose the right of withdrawal once the service has been fully performed. Accordingly:

  • Service not yet fully performed: the user retains the right of withdrawal for 14 calendar days and will be refunded the amount paid, less the proportionate part of the services actually provided up to the time of notification, calculated on the total price of the service.
  • Service fully performed — that is, the property withdrawn from the market and the application fully processed: the right of withdrawal is extinguished under Article 103.a) of Royal Legislative Decree 1/2007, and the retention regime set out in section 7.2 applies.
  • Tenancy agreement already signed: withdrawal would affect only the service contract with EasyRent, with the tenancy remaining subject to its own legal and contractual regime.

In all cases the amount will be refunded where a duly evidenced event of force majeure occurs.

9. Complaints

EasyRent has official complaint forms available to consumers and users, in accordance with the regulations of the Generalitat Valenciana. You may request them at our offices or by writing to info@easyrent.es.

Complaints may be addressed to info@easyrent.es. We undertake to acknowledge receipt within a maximum of 5 working days and to resolve the matter within a maximum of one month.

Users may also contact the consumer services of the Generalitat Valenciana or of Valencia City Council, as well as the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/

10. Intellectual property

The contents of the website (text, photographs, design, code and property databases) belong to EasyRent or to third parties who have authorised their use. Their reproduction, distribution or transformation without express written authorisation is prohibited.

11. Liability

EasyRent is responsible for the proper provision of the services it contracts directly with its clients, in accordance with the terms of each contract.

EasyRent is not responsible for:

  • Decisions taken by property owners.
  • Breach of contractual obligations by landlords or tenants.
  • The accuracy of information provided by third parties about properties.
  • Interruptions, errors or unavailability of the website.

Nothing in these Terms excludes or limits EasyRent’s liability where such exclusion would be contrary to applicable law, in particular in respect of consumers and users.

12. Communications

Communications between EasyRent and the user will take place primarily by email to the addresses provided. The user undertakes to keep their contact address up to date.

13. Partial invalidity

If any clause of these Terms is declared void or unenforceable, such invalidity shall not affect the validity of the remainder, which shall remain in force.

14. Amendments

EasyRent may amend these Terms at any time. The applicable version will be the one published on the website at the time of access. Periodic review is recommended.

15. Governing law and jurisdiction

These Terms are governed by Spanish law.

Where the user is a consumer, the Courts of their place of residence shall have jurisdiction. In all other cases, the parties submit to the Courts of Valencia.

16. Language

This document is a translation of the Spanish original. In the event of any discrepancy between the two versions, the Spanish version shall prevail.
